    Welcome to Touch AI. These Terms and Conditions ("Terms", "Terms of Service") govern your use of the touchai.agency website and the software infrastructure, automations, and services provided by Touch AI ("the Company", "We", "Us", or "Our").

    By accessing our website or purchasing our Minimal Viable Service (MVS) infrastructure, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

    1. Services Provided

    Touch AI provides automated marketing infrastructure, including but not limited to Missed-Call Text Back systems, Web Chat Widgets, Automated Lead Follow-up, Unified Inboxes, and Reputation Management systems.

    • Setup Period: We agree to deploy your base infrastructure within 48 business hours of receiving all necessary onboarding materials and account access from the client.
    • Platform: Our services are built and hosted utilizing third-party infrastructure. By using our services, you also agree to the acceptable use policies of our underlying infrastructure providers.

    2. Payment Terms and Subscriptions

    • One-Time Build Fee: A non-refundable setup fee (unless covered by our Guarantee) is required to build and integrate your system.
    • Monthly Subscriptions: Our ongoing services are billed on a month-to-month subscription basis (e.g., the Elementary or Premium tiers). You will be billed in advance on a recurring and periodic basis (monthly).
    • Cancellation: You may cancel your monthly subscription at any time by contacting support@touchai.agency at least 7 days before your next billing cycle. No prorated refunds are provided for partial months.

    3. The "First Catch" 30-Day Guarantee

    We offer a conditional money-back guarantee on the initial Setup Fee.

    • The Condition: If our system does not objectively capture at least one (1) lost lead (such as executing a successful missed-call text back or capturing a web chat lead) within the first thirty (30) days of the system going live, we will refund your initial setup fee.
    • Exclusions: This guarantee is void if the client alters our automations, fails to connect their phone lines, or refuses to place our widgets on their live website. Monthly subscription fees are non-refundable.

    4. SMS and Messaging Compliance (A2P 10DLC)

    Touch AI provides tools for SMS text messaging. You are strictly responsible for complying with all local and federal laws regarding telemarketing and text messaging, including the Telephone Consumer Protection Act (TCPA) in the United States.

    • You agree to only send text messages to individuals who have explicitly opted in to receive communications from your business.
    • You agree not to use our infrastructure to send spam, illegal content, or unapproved marketing blasts.
    • Touch AI reserves the right to immediately suspend your account without refund if we detect a violation of carrier SMS rules or a high spam-complaint rate.

    5. Client Responsibilities

    To ensure the 48-hour deployment, the client must provide timely access to necessary third-party accounts (e.g., DNS records for domain connection, Google Business Profile, Facebook page). Touch AI is not responsible for delays caused by the client's failure to provide access.

    6. Intellectual Property

    All custom automations, workflows, code, and "Snapshots" deployed into your account remain the intellectual property of Touch AI. You are granted a limited, non-exclusive license to use these systems while you maintain an active monthly subscription. Upon cancellation, access to these proprietary workflows will be revoked.

    7. Limitation of Liability

    To the maximum extent permitted by applicable law, in no event shall Touch AI, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

    8. Governing Law

    These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
